TERMS OF SERVICE — ALERTA ACCESS
Effective Date: May 2026 | Governed by the Laws of the State of Florida
1. Acceptance of Terms
By accessing or using the Alerta Access platform (the 'Platform'), operated by Alerta Global Inc ('Company,' 'we,' 'us,' or 'our'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including students, instructors, and visitors.
2. About Alerta Access
Alerta Access is a Spanish-language online learning platform that connects students with creators, influencers, and subject-matter experts through recorded courses, live experiences, workshops, bootcamps, and one-on-one mentorships. The Platform is owned and operated by Alerta Global Inc, headquartered at 535 5th Ave, New York, NY 10017.
3. Eligibility
To use the Platform, you must:
Be at least 18 years of age, or have verifiable parental or guardian consent if between 13 and 17 years of age
Have the legal capacity to enter into binding agreements
Not be prohibited from using the Platform under applicable law
Provide accurate, complete, and current registration information
4. Account Registration
To access paid features, you must create an account. You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use at hello@alertacreative.com
Alerta Access reserves the right to suspend or terminate accounts that violate these Terms.
5. Platform Services
Alerta Access offers the following services:
Recorded Courses: Pre-recorded educational content created by instructors
Live Experiences: Real-time sessions including workshops, bootcamps, and live events
One-on-One Mentorships: Private sessions between a student and instructor
Subscriptions: Access to course libraries or instructor content through recurring billing
Access to specific content may require purchasing individual courses, subscribing to a plan, or booking a mentorship session.
6. Payments and Billing
All transactions on the Platform are processed in US dollars. By making a purchase, you authorize Alerta Access to charge your selected payment method. Subscription plans are billed regularly (monthly or annually) until canceled. You are responsible for all charges incurred under your account.
7. Refund and Credit Policy
Please refer to our Refund and Credit Policy (Document 03 of this package) for complete details. In summary, all sales are final. No monetary refunds will be issued. Platform credits may be granted under limited conditions as described in that policy.
8. Intellectual Property
All content on the Platform, including course materials, videos, text, graphics, and branding, is the property of Alerta Global Inc or the respective instructor. You may not reproduce, distribute, modify, or create derivative works without prior written permission. Purchasing access to a course grants you a personal, non-transferable, non-exclusive license to view that content for personal use only.
9. Instructor Content
Instructors are independent creators, not employees of Alerta Global Inc. Alerta Access does not guarantee the accuracy, completeness, or quality of instructor-provided content. Students use instructor content at their own discretion.
10. Prohibited Conduct
You agree not to:
Share, resell, or distribute course content without authorization
Use the Platform for any unlawful purpose
Harass, threaten, or abuse other users or instructors
Attempt to gain unauthorized access to the Platform or its systems
Post false, misleading, or defamatory reviews or content
Use automated tools to scrape, copy, or extract Platform content
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice. Upon termination, your right to access the Platform ceases immediately. Credits and purchased access are forfeited upon termination for cause.
12. Limitation of Liability
To the maximum extent permitted by Florida law, Alerta Global Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you shall not exceed the amount you paid in the twelve (12) months preceding the claim.
13. Disclaimer of Warranties
The Platform is provided 'as is' and 'as available' without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or harmful components.
14. Governing Law and Dispute Resolution
The laws of the State of Florida govern these Terms. Any disputes shall be resolved through binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association, except where prohibited by law. You waive any right to a jury trial.
15. Changes to These Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.
